POLICIES OF OPERATION

ACCEPTANCE OF TERMS
Covenant Games provides its service to you, subject to the following terms and conditions, which we may update at any time without prior notice to you (the "dealer"). In addition, when using particular Covenant Games services, you and Covenant Games shall be subject to any of the following guidelines or rules. By placing an order, dealer indicates acceptance of all posted terms and conditions.

PRICING
Dealer cost per item is clearly stated on our PRODUCTS pages, and ORDER FORM. Most prices are figured at 45% off of the MSR (Manufacturer Suggested Retail price).  Item will vary in discount, but will be at least 30% off of MSR. 

All dealers are required to advertise and promote sales of products for NO MORE than 20% off of the MSR (Manufacturer Suggested Retail), in addition any product from Mayfair Games (part# starts with MFG) may be NO MORE than 10% off of MSR. In the event that any dealer is found to be advertising products at more than a 20% (10% for MFG) discount, that dealer is subject to immediate account suspension, as per the discretion of Covenant Games. Internet auctions are not subject to this requirement, since they are demand-driven, so long as the "buy now" price is not more than 20% (10% for MFG) off of the MSR.

TERMS OF SALE
All sales are prepayment only. Covenant Games accepts Visa, Master Card, Discover, American Express via PayPal, check, money order and PayPal. Our recommended method of payment is for credit card (via PayPal) payment online, at our shopping cart, with shipping rates automatically figured at the time of payment--this prevents any delays in processing payments. Covenant Games is happy to accommodate other payment options as per dealer preference, but please keep in mind that we will ship orders 1-3 business days after payment has been received.

SHIPPING & DROPSHIP FEES
Dealer is responsible for actual shipping costs, plus a standard $2.50 drop ship fee (per order, not per box). This $2.50 drop ship fee is factored into the calculated shipping rates which come directly from USPS or UPS systems using weight and destination. Shipping weights are figured based on the listed weight for each item plus 1/3 lb for shipping materials.  All packages will be shipped from the 55901 zip code via UPS or USPS, to be specified by the dealer at the time the order is placed.  (note:  if you choose a rush option like UPS Next Day Air, please send us a note  giving us a heads up so that we can give the order rush processing)

Covenant Games uses auto-notification for UPS and US Postal Service tracking numbers.  This notification will be sent to the email address attached to your order. Dealer is responsible to inform Covenant Games of lost or damaged shipments. ALL shipping charges and drop ship fees are non-refundable.

Dealer pays for all shipping and drop ship fees at the time of purchase, as calculated by our shopping cart. Dealer is responsible for all shipping charges for unaccepted or refused delivery of shipments. Dealer is responsible for supplying all shipping rate quotes to their customers. Covenant Games can not be held responsible for differences between dealer-quoted shipping costs and actual shipping costs. International shipping is available via USPS, though dealer assumes all additional risks involved with international orders, including border delays and customs charges.  First class mail is available for some small orders, however tracking is not offered for first class mail and dealer assumes all risk for lost first class mail packages.

BACKORDERS
Covenant Games strives to maintain a complete inventory of our offered product line. Items that are backordered or out of stock are listed but not available to be purchased in the ordering system.  All items have the quanity in stock listed in the ordering system.  Status of backordered items and stock quatity summaries can be found by downloading stock list spreadsheet at http://www.elentine.com/products.htm

RETURN POLICY
Dealer is responsible to contact Covenant Games on behalf of their customers regarding all returns. No returns will be accepted without prior return authorization. Return authorization must be obtained within 30 days of ship date, and are valid 30 days from date of issuance. Please note the following return conditions and how appropriate credits are determined.

• Customer received order, but item(s) are defective/damaged upon receipt (manufacturer defect)
  • Manufacturer Defect - Covenant Games or the manufacturer will arrange replacement at NO additional shipping or handling costs. If defective product must be returned to manufacturer, Covenant Games will pay for all return shipping.
  • Shipping damage - Covenant Games will replace damaged items at NO additional shipping or handling costs.  Customer must retain damaged item for UPS or Postal inspection.
• Customer refuses delivery, or package is returned to Covenant Games as undeliverable
  • Covenant Games will issue a credit for cost of item(s), minus 15% restocking fee.
• Customer accepts order, then wants to return it for personal reasons
  • Covenant Games will issue a credit for cost of item(s), minus 15% restocking fee, once the item(s) has been returned to us (return shipping at customer's expense) and confirmed to be in resalable condition. Addition restocking fees will be assessed for item(s) not received in resalable condition.

All returns should be sent to: Covenant Games, 825 37th Ave NW, Rochester, MN 55901. Return authorization number should be clearly visible on outside of box, and on enclosed note briefly describing the reason for the return. Allow up to 5 business days for Covenant Games to process returns from the date they are received.

CANCELLATIONS
All orders/backorders may be cancelled prior to shipping, at no cost to customer. Cancellations must be made in writing via email or fax.

PROCESSING
All orders will be processed and ship 1-3 business days from the time that payment is confirmed. All orders placed after 4pm (Central Time) will not be received by Covenant Games until the following business day.  Covenant Games is happy to accommodate faxed, mailed or emailed orders, to accommodate dealer needs, and will strive to return shipping quotes, as per dealer-selected payment preference, as quickly as possible to prevent any further delays in shipping. HOWEVER, we strongly recommend prepayment by credit card at our online shopping cart, using real-time shipping calculations, to prevent any possible delays--remember, we will ship orders 1-3 business days after payment has been received.

INDEMNITY
You (the "dealer") and your customer (the "customer") agree to indemnify and hold Covenant Games, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the above services (the "service"), your connection to the service, your violation of said service, or your violation of any rights of another.

LIMITATION OF LIABILITY
Dealer expressly understands and agrees that Covenant Games shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to: damages for loss of profits, goodwill, use, data or other intangible losses (even if Covenant Games has been advised of the possibility of such damages), resulting from the use or the inability to use the service; the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; unauthorized access to or alteration of your transmissions or data; statements or conduct of any third party on the service; or any other matter relating to the service.
